YucatanLove Travel Concierge is an e-commerce site and offers its users a platform for the exchange of information and experiences of tourist destinations, tourist attractions and other tour related services.
The USERS, in the understanding that they are any person who makes use of or accesses any of the pages, web applications and/or mobile applications, software, developments and/or applications in general, that integrate the site and/or domain IMPULSORA DE TURISMO DE ROMANCE, SAPI DE CV (YUCATÁNLOVE), and/or https://yucatanlove. com (hereinafter and, jointly and indistinctly, the “SITE”), by means of computer equipment and/or any communication equipment or device (hereinafter the “USERS”), agree not to use devices, software, or any other means tending to interfere both in the activities and/or operations of the SITE, in the databases and/or information contained therein.
To the persons who interact, review, manipulate, send or simply enter the site https://travel.yucatanlove.com who are called and defined here as USERS, we inform you that the following Terms and Conditions are applicable to them by the simple use or access to the SITE, so we understand that all USERS accept and agree to be bound to comply with all the Terms and Conditions that we will present and develop hereinafter. However, if you do not agree with these Terms and Conditions, you should refrain from accessing or continuing to use our SITE.
IMPULSORA DE TURISMO DE ROMANCE, SAPI DE CV (YUCATÁNLOVE), and/or its subsidiaries, controlling companies, related parties and/or affiliates (hereinafter and, jointly and severally, “YL”) reserve the right to modify the content of the SITE at their discretion at any time, without prior notice to USERS.
1.1. These terms and conditions are subject to change from time to time and apply to all our services provided directly or indirectly (e.g. through third parties) via the Internet, mobile devices, email or telephone.
1.2. By using our website, you confirm that you have read, understood and accepted these terms and conditions, as well as the privacy policy, including the use of cookies.

2.2. YucatanLove Travel Concierge collects, processes and uses your personal data (hereinafter “data”) only if it has obtained your consent or a legal provision allowing the collection, processing or use of your data.
2.3. YucatanLove Travel Concierge collects, processes or uses such data that is necessary for the performance of the services offered by YucatanLove and/or for the use and operation of the website/applications.
3.1. The user is responsible for acquiring the rights for the content (text, photos, opinions, links, etc.) that they upload to YucatanLove Travel Concierge. They must ensure that they own all rights to the content they post on the platform and therefore do not violate the rights of third parties.

USERS do not have the right to place hyperlinks within the SITE, to use the links of the SITE, nor the right to place or use the SERVICES AND CONTENT on their own or third party sites or pages without prior written authorization from YL, USERS may not prevent any other USER from using the SITE or the SERVICES AND CONTENT.
INTELLECTUAL PROPERTY.
The intellectual property rights, copyrights, industrial property regarding the SERVICES AND CONTENTS, distinctive signs and domains of the Pages or the SITE, as well as the rights of use and exploitation of these, including but not limited to their disclosure, publication, reproduction, distribution and transformation, are the exclusive property of YL. USERS do not acquire any intellectual property rights, copyrights and/or industrial property rights by simply using or accessing the SERVICES AND CONTENTS of the SITE and, at no time, said use shall be considered as an authorization or license to use the SERVICES AND CONTENTS for purposes other than those contemplated in these Terms and Conditions.
INTELLECTUAL PROPERTY OF THIRD PARTIES.
USERS agree that the provisions set forth in article 3 three above regarding the ownership of YL’s rights are also applicable to the rights of third parties with respect to the SERVICES AND CONTENT of the Pages, domains or information presented or linked to the SITE.
QUALITY OF THE SERVICES AND CONTENTS AND THEIR GUARANTEES.
Neither YL, nor its suppliers or business partners, shall be liable for any damage or harm suffered by USERS as a result of inaccuracies, queries made, typographical errors and changes or improvements made periodically to the SERVICES AND CONTENTS and the SITE. The SERVICES AND CONTENTS, recommendations and advice obtained through the SITE are of a general nature, so they should not be taken into account in the adoption of personal, commercial or professional decisions, for which an appropriate professional who can advise USERS according to their specific needs should be consulted. YL offers tools and materials through the SITE for the preparation of the SERVICES AND CONTENT offered, so that all SERVICES AND CONTENT, including without limitation, descriptions, information, definitions and any other resources, are informational and general in nature strictly speaking, are not of an opinion or legal advice nature, YL does not warrant that they are correct or up to date. YL offers the SERVICES AND CONTENT with a reasonable level of competence and diligence from a commercial point of view, but makes no warranties of any kind in connection therewith. The SITE is provided by YL on an “as is” and “as available” basis, and YL makes no representations or warranties of any kind, express or implied, regarding the operation of the SITE, information, content, materials, services or products included. USERS expressly agree that use of the SITE is at their own risk, and YL reserves the right to remove or delete any information from the SITE, at any time, in its sole discretion. Neither YL, nor its suppliers, business partners or distributors make any specific warranties about the SERVICES AND CONTENT; YL excludes all warranties to the extent permitted by applicable law.
In accordance with the Terms and Conditions, YL does not assume and will not assume any liability to any person, derived or that could be derived from the SERVICES AND CONTENTS, navigation on the SITE, consultations, clarifications and/or any other kind of response given by YL by any means of communication. USERS agree to indemnify and hold harmless YL at all times, for any reason or circumstance, its shareholders, subsidiaries, affiliates, officers, directors, employees, consultants, agents, representatives and/or any person related to it, from any liability that may be imputed under and/or in connection with the Site, the provision of the SERVICES AND CONTENT or any other derived from these Terms and Conditions. USERS understand and agree that YL shall be limited by liability of any kind, in all cases, to the amount paid as consideration for the SERVICES AND CONTENT.
PAYMENTS.
YL in its sole discretion may change the price of each of the SERVICES AND CONTENT within the SITE at any time. Payment for the SERVICES AND CONTENT may be made by the following payment methods:
1.- Payments through the payment platform/gateway used by YL (hereinafter “PAYMENT PLATFORM”); YL through the PAYMENT PLATFORM will charge the USERS’ debit or credit card, upon authorization, for payment of the SERVICES AND CONTENT, interest-free months, cash or recurring charges. USERS acknowledge and agree that the PAYMENT PLATFORM reserves the right to decline a transaction for any reason and, if applicable, neither the PAYMENT PLATFORM nor YL shall be liable for such declined payments. When payments are made through the PAYMENT PLATFORM, all capture of USERS’ credit or debit card information is carried out on the PAYMENT PLATFORM processor’s platform and servers, under its own security standards. USERS by using the SITE acknowledge and accept without reservation the Terms and Conditions, as well as the Privacy Notice of the PAYMENT PLATFORM, leaving YL free of any liability and claim for the handling of their information.
REFUNDS AND CANCELLATIONS.
USERS acknowledge that charges made to debit or credit cards, as well as payments made through SPEI (electronic transfer or cash payment using the receipt generated for it), on the occasion of the SERVICES AND CONTENT, will not be subject to refund and, that by making such payments is subject and accepts without reservation to the Terms and Conditions and Privacy Notice of the service providers related to such payments. To the extent permitted by applicable law, any payments made are non-refundable and no refunds or credits will be given by YL.
4.1. All agreements arising through this service are between the user of YucatanLove Travel Concierge and the contracted tour, the terms and conditions of the respective tour organizer or tour provider apply exclusively especially with regard to the right of cancellation and withdrawal. The contract for the processing of reservations and payment, as well as questions about the contract are those of the booking site that is contracted.
4.2. In particular, hyperlinks, advertising banners, information about accommodations, travel destinations or suppliers and the like are provided by the tour providers and do not represent recommendations or information from YucatanLove. Due to technical issues, the price updates we receive from tour providers are not made in real time. Consequently, it is possible that the price displayed on the site does not correspond to the one specified with the suppliers. YucatanLove cannot guarantee the accuracy of the information, especially regarding prices and availability.
YucatánLove is not responsible for technical errors whose cause is beyond the scope of responsibility of YucatánLove or for damages caused by force majeure. YucatánLove does not guarantee uninterrupted availability of data and may perform maintenance work during a freely chosen period of time.
GOODS AND SERVICES OF LINKED THIRD PARTIES.
The fact that information is offered on the SITE or other linked sites does not imply YL’s recommendation, warranty, sponsorship or endorsement of such information, goods and/or services. The availability of goods and/or services offered by third parties or linked sites is not the responsibility of YL. By virtue of the foregoing, YL shall not be liable to any authority of any nature whatsoever for any matter relating to the sale, consumption, distribution, delivery, availability or performance with respect to any of the goods and/or services offered by third parties or by linked sites through the SITE. With respect to SERVICES AND CONTENT provided by third parties within or through links to the SITE (such as links, banners and buttons), YL is limited solely, for the convenience of USERS, to: (i) inform USERS about the same and, (ii) to provide a means to put USERS in contact with suppliers or vendors. The products and/or services marketed within the SITE and/or on linked third party sites are provided by independent merchants and shall in no way be construed to be the responsibility of YL. There is no employment relationship, partnership or association between YL and such third parties, all advice, counsel, statements, information and content of the linked third party sites or within the SITE represent the opinions and judgments of such third party, consequently, YL shall not be liable for any damages or injury suffered by USERS as a result thereof.
CONFIDENTIALITY.
YL is obliged to keep confidential the information it receives from USERS that has such character in accordance with the applicable legal provisions in the United Mexican States; YL assumes no obligation to keep confidential any other information that USERS provide to it, YL may disclose the information of the User and the SERVICES AND CONTENT acquired by it to those third parties who, by virtue of the services and products offered and acquired, need to know them to fully comply with them. Likewise, YL may disclose your information to the competent authorities in terms of the applicable legislation; any transfer of your personal data without consent will be made in accordance with Article 37 of the LFPDPPP (Federal Law for the Protection of Personal Data in Possession of Private Parties).
USE OF NON-CONFIDENTIAL INFORMATION.
By using the SITE, USERS authorize YL, including but not limited to, to use, publish, reproduce, disclose, publicly communicate and transmit non-confidential information, in terms of the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties, the Federal Copyright Law, the Federal Consumer Protection Law and any other applicable Mexican law.
COOKIES.
USERS who access the SITE agree to receive files transmitted to them by YL servers, a “Cookie” is a data file that is stored on the hard drive of the USER’s computer when the USER accesses the SITE. Such files may contain information such as the identification provided by USERS or information to track the pages that USERS have visited. A Cookie cannot read data or information from the USERS’ hard disk nor read Cookies created by other sites or pages, generally, Cookies are accepted automatically, USERS can change their browser settings at any time. In the event that USERS decide to reject Cookies, it is possible that certain sections of the SITE may not function optimally or may not function at all.
PERSONAL DATA PRIVACY NOTICE.

YL shall have the right to modify, at any time, the Terms and Conditions, without prior notice and/or consent of the USERS, consequently, the USERS must carefully read the Terms and Conditions each time they intend to use the SITE. Certain SERVICES AND CONTENT offered to USERS on and/or through the SITE are subject to specific conditions that replace, complete and/or modify these Terms and Conditions. Consequently, USERS should also carefully read the corresponding particular conditions before accessing any of the SERVICES AND CONTENTS.
FINAL PROVISIONS.
FORCE MAJEURE.
Under no circumstances shall YL or its attorneys, accountants and/or professionals as the case may be or suppliers be liable for any delay or failure in performance resulting directly or indirectly from an event beyond their reasonable control (act of God or force majeure).
NO WAIVER.
If we do not insist that you perform any obligation under these Terms and Conditions, or if we do not enforce our rights against USERS or delay in doing so, this does not mean that we waive such rights and does not mean that USERS do not have to comply with their obligations, if we decide to waive our rights in relation to any breach or default by you, we may only do so in writing and this does not mean that we will automatically waive any future breaches that you incur but only those matters in respect of which we have specifically waived.
SEVERABILITY.
Each of the provisions of these Terms and Conditions is executed separately, if any court or competent authority decides that any of them is illegal or invalid, the remaining provisions will remain in full force and effect.
THIRD PARTY BENEFICIARIES.
USERS agree that, unless otherwise expressly stated in these Terms and Conditions, there shall be no third party beneficiaries of these Terms and Conditions.
OTHER PROVISIONS.
These Terms and Conditions (and all terms and conditions incorporated herein) constitute the entire agreement between USERS and YL, and supersede any prior agreements entered into between USERS and YL in connection with the subject matter hereof, except as otherwise explicitly provided in this Terms and Conditions document, these Terms and Conditions, and any rights or licenses granted hereunder, may not be assigned or delegated by USERS.
These Terms and Conditions, and any rights or licenses granted hereunder, may be assigned or delegated without restriction by YL. These Terms and Conditions are binding upon and shall inure to the benefit of each party or the parties’ permitted assigns or successors. These Terms and Conditions may not be modified by an oral statement made by a representative of YL. These Terms and Conditions are not intended or intended to create any agency, partnership, joint venture or employer/employee relationship, USERS agree that any agreement entered into between USERS and YL in electronic form is legally binding as if it had been made in physical form and in writing.
If USERS use the SITE for or on behalf of the government of any jurisdiction, their license rights shall not be superior to those granted to non-government consumers. The section headings in these Terms and Conditions are for convenience only and have no legal or contractual effect. Any provision of these Terms and Conditions that, by its nature, is reasonably intended to survive termination shall survive termination.
NOTICES AND CONTACT.
We may send notices to you by e-mail, post notices on the SITE or any other method we choose, and such notice will be effective upon delivery. If USERS send us a notice, it will be effective when we receive it by postal mail at the address posted on the SITE.
